This Draw Terms & Conditions document (hereinafter, the ''Terms & Conditions'') reflects the terms and conditions of the Draw (hereinafter, ''the Promotion'').
For further information, please contact RUBI TOOLS GROUP, S.A. (hereinafter, the "Organiser'') by email or by post to the addresses above.
2.- PROMOTION DESCRIPTION
The Promotion is considered a random combination (draw) in accordance with Law 13/2011, of 27 May, regulating gambling and other applicable Spanish regulations, insofar as the means of determining the winner among the participants depends solely and exclusively on chance.
3.- PARTICIPATION REQUIREMENTS AND HOW THE PROMOTION WORKS
3.1 Participation requirements
3.1.1 Be of legal age and register for the Promotion by using the relevant form/card provided (hereinafter referred to as the ''Participant'' or ''Participants'').
3.1.2 A copy of these Terms & Conditions will be made available to Participants at the time they express their interest in participating in the Promotion for their review and subsequent approval. Only after the Participant has examined them, can the registration form/ticket be completed. This form can even be completed using a QR code. Providing this data in the indicated format and checking the corresponding box will imply the express and unequivocal acceptance of the interested party and the holding of the condition of Participant. To this end, the Participant must expressly accept and agree to these Terms & Conditions by means of the checkbox provided for this purpose on the participation form/ticket. These Terms and Conditions will be made available through the mechanism used to inform the Participant. Non-acceptance will prevent them from being a Participant and, therefore, from the possibility of winning the Promotion.
3.1.3 The data provided by the Participants on the participation form or ticket must be true and no personal data of third parties may be provided.
3.1.4 Participants may only complete one (1) participation form/ticket per Promotion, and the Organiser may reserve the right to exclude any individual who violates this provision from participation in the Promotion.
3.2 How the Promotion works and selection of the winning Participant
3.2.1 In order to determine the winning Participant, a third party application will be used to randomly determine the winning Participant, independent of the Organiser. In the event that paper form(s)/card(s) are available, a manual draw will also be carried out to determine the Winning Participant.
3.2.2 No additional requirements are necessary for the draw in accordance with the above.
3.2.3 Once the winning Participant has been determined, he/she will be notified by electronic means. If it is not possible to locate and notify them, the Participant who has been established as the reserve Participant will be notified as the winning Participant. If there are no reserves, the process will be repeated to determine the winning Participant.
4.- AWARD AND PRESENTATION
4.1 The prize may consist of a product or batch of products determined by the Organiser or any other product and/or service or experience determined by the Organiser as well as the allocation of points redeemable for products and services of the Organiser.
4.2 The presentation will be agreed with the Winning Participant.
5.- START AND END DATE
5.1 The Organiser will indicate the start and end dates, which will be determined by the opening and closing of the registration process in the Promotion.
5.2 The Promotion will take place with a frequency indicated by the Organiser.
6.- LIMITATIONS
6.1 If it becomes evident that any of the Participants does not comply with the requirements of the Terms & Conditions, or the data provided for participation is not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to obtain any prize regardless of whether the prize has been awarded or not.
6.2 The following persons may not participate in the Promotion: (i) Workers employed by any of the companies and other entities with legal status linked to the Organiser; (ii) Individuals who participate directly or indirectly in the capital of the Organiser; (iii) Any other individual who has participated directly or indirectly in the organisation of this Promotion or has been involved directly or indirectly in its preparation or development.
6.3 The prize awarded will not be transferable or subject to change, alteration or compensation at the request of the Participants, and cannot be exchanged for any other product or for money.
6.4 The Organiser reserves the right, if there is just cause, to make any changes, suspend or extend this Promotion.
6.5 The winning Participant will be responsible for any fiscal or tax burden that the acceptance of the prize may entail, as well as any other expense derived from the Promotion that is not expressly assumed by the Organiser in these Terms & Conditions.
6.6 A period of TEN (10) calendar days is established from the date of the award of the prize to make any justified claim.
6.7 The Organiser reserves the right, if necessary, to replace the prize with another of similar characteristics if this has been specifically published prior to the award of the prize.
7.- PUBLICATION OF COMMENTS OR OPINIONS
7.1 No comments or opinions will be permitted whose content is considered inappropriate, offensive, insulting or discriminatory or which could infringe the rights of third parties. Nor shall comments be permitted against an individual that violate the principles of the right to honour, personal and family privacy and image.
7.2 The Organiser is not responsible for any damage caused by the comments made by participants in the Promotion, and that at any time could hurt the sensitivity of other participants or third parties.
8.- ACCEPTANCE OF THE TERMS & CONDITIONS
8.1 The Participant expressly agrees to comply with each and every one of the Terms & Conditions of this draw. Failure to comply with any of the clauses of these Terms & Conditions will result in the total exclusion of the user from this Promotion. In case of doubts or discrepancies in the interpretation of these rules, the criteria of the Organiser will prevail.
8.2 On reasoned grounds, the Organiser may change these Terms & Conditions after the start of the Contest. Contestants may consult the Terms & Conditions of this Contest during the period in which the promotion(s) are in force on the Promotion Landing page.
9.- EXCLUSION OF LIABILITY
9.1 By way of illustration only, and not by way of limitation, the Organiser is not responsible for any loss, theft, delay or any other circumstance attributable to third parties that may affect the normal course of this Promotion, nor is the Organiser responsible for the use made by the Participant with respect to the prize obtained from this Promotion, and assumes no responsibility for any damages of any kind that may be suffered by the Participants, winner or third parties.
9.2 The Organiser does not assume responsibility in cases of force majeure or fortuitous events that could prevent the realisation of the Promotion or the total or partial enjoyment of the prize. In the event that this Promotion could not be carried out, either due to frauds detected in it, technical errors, or any other reason not under the control of the Organiser and affecting the normal development of the Draw, the Organiser reserves the right to cancel, modify or suspend it without any formal requirement.
10.- PERSONAL DATA PROTECTION
10.1 In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016 ,on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, in Organic Law 3/2018, of 5 December, on Data Protection and the guarantee of digital rights, as well as other applicable regulations, we inform you that the data provided by the Participant as well as those that he/she may provide in the event of being a winning Participant or exercising his/her rights will be incorporated into the processing system of RUBI TOOLS GROUP, S.A. (Data Controller) whose identification details are indicated in clause 1, ''Draw Organiser''.
10.2 The purpose for which we will treat your personal data will be the control, monitoring and management of the Draw, respecting all the appropriate security measures, which will involve the possibility of contacting you to notify you of your status as a winning Participant, as well as the necessary activities for advertising purposes or dissemination through our website and through the social networks of the Data Controller.
10.3 Providing your personal data is voluntary. Notwithstanding the above, if you do not provide them, you will not be able to participate in the Promotion. The omission or refusal to submit the data provided will make it impossible to fulfil the aforementioned purpose.
10.4 The personal data provided will be kept for the duration of the draw and until the legal periods of limitation in order to safeguard any kind of liability, and blocking obligations may operate in accordance with applicable regulations.
10.5 There will be no transfer of your personal data unless required by law.
10.6 The Participants can exercise their rights by sending a written communication to the email address clubrubi@rubi.com, or by post to the address of the Organiser indicated in clause 1 ''Draw Organiser'', in which the detailed request and contact details are clearly stated. A photocopy of the ID card or other equivalent identification document must also be attached. His/her rights are:

- Deletion
- Opposition
- To file a complaint with the Spanish Data Protection Agency (AEPD) https://www.aepd.es
- To withdraw consent without affecting data handling carried out prior to the withdrawal of consent.
We also inform you that no profiling or automated decision making will take place.

12.- CHANGES
The Organiser reserves the right to modify or extend these Terms & Conditions unilaterally without any formal act or notification.
13.- APPLICABLE LAW AND JURISDICTION
13.1 These Terms & Conditions shall be governed by Spanish law.
13.2 The Courts and Tribunals of the city of Barcelona shall be competent to resolve any claim or controversy that may arise regarding the validity, interpretation or fulfilment of these Terms & Conditions.
